असार ७, काठमाडौं । सुदूरपश्चिम प्रदेश सरकारको मन्त्रिपरिषद्लाई सर्वोच्च अदालतले वैधानिकता दिन अस्वीकार गरेको छ ।
सुदूरपश्चिम सरकारको मन्त्रिपरिषद्को वैधानिकतामा न्यायाधीशद्वय दीपककुमार कार्की र कुमार रेग्मीको इजलासले प्रश्न उठाउँदै दायर भएको रिट निवेदनमा अन्तरिम आदेश जारी गर्न अस्वीकार गरेको हो ।
‘नेपालको संविधान धारा १६८ (९) को व्याख्याको विषय सन्निहित रहेकाले अहिले नै सो सम्बन्धमा विस्तृत व्याख्या गरी अन्तरिम आदेश जारी गर्न मिलेन,’ नेपालको संविधानको धारा १६८ को उपधारा ९ मा भनिएको छ, ‘मुख्यमन्त्रीसहित प्रदेश सभाको कूल २० प्रतिशतभन्दा बढी नहुने गरी मन्त्रिपरिषद् गठन गर्ने’ भन्ने व्यवस्था रहेको छ ।
आदेशमा विषयवस्तुको गम्भीर्य हेर्दा शीघ्र निरुपण गर्नुपर्ने भएकाले विपक्षीको लिखित जवाफ परेको मितिले सातदिनभित्र पूणर् सुनुवाइका लागि नियमानुसार पेश गर्न भनिएको छ । न्यायाधीश हरिकृष्ण कार्कीको एकल इजलासले यसअघि अन्तरिम आदेशको छलफलका लागि लिखित जवाफ माग गर्ने आदेश जारी गरेको थियो ।
सुदूरपश्चिमको मन्त्रिमण्डल संविधानको धारा १६८ ले तोकेको मापदण्डभन्दा धेरै भएको अधिवक्ता कमलसिंह राना र अपेक्षा निरौलाले उल्लेख गर्दै सर्वोच्च अदालतमा रिट निवेदन दायर गरेका थिए । हालः सुदूरपश्चिममा छ मन्त्रालयमा ११ मन्त्री बनाएको हुँदा सो निणर्य बदर गर्न माग गरी रिट निवेदन दिइएको थियो ।
